Safeguarding and Regulated Activity

Introduction

It has been a requirement since 2007 that all schools maintain a SINGLE CENTRAL RECORD of recruitment and vetting checks. At Chesswood there are four levels of registration:

1. No registration - no contact with children, not regular or large school event with managed risk e.g. summer fair

2. School Registration - basic information shared and ID checked; controlled contact or no contact with children and not regular

3. Personnel Registration - generally included due to regularity supporting other aspects such as next of kin contact, parking, linked school leader. Vetting checks may be made but this doesn't automatically place a person on the single central record e.g. Initial Teacher Training Students

4. Single Central Register - all staff, including teacher trainees on salaried routes agency and third-party supply staff, even if they work for one day. For agency and third-party supply staff, schools and colleges must include whether written confirmation has been received that the employment business supplying the member of supply staff has carried out the relevant checks and obtained the appropriate certificates, the date this confirmation was received and whether details of any enhanced DBS certificate have been provided in respect of the member of staff.

The single central record must indicate whether the following checks have been carried out or certificates obtained, and the date on which each check was completed or certificate obtained

Identification

We expect to see identification for almost all adult school visitors. Typically, we will expect to see official photo ID such as a driving licence or a passport.

Disclosure and Barring Checks

An employer may request a DBS check as part of their recruitment process. These checks are processed by the Disclosure and Barring Service (DBS).

The types of check are as follows:

  • a basic check, which shows unspent convictions and conditional cautions

  • a standard check, which shows spent and unspent convictions and adult cautions, from the Police National Computer which have not been filtered in line with legislation

  • an enhanced check, which shows the same as a standard check plus any information held by local police that’s considered relevant to the role

  • an enhanced check with a check of the barred lists, which shows the same as an enhanced check plus whether the applicant is on the adults’ barred list, children’s barred list or both

Teacher Status Checks

Teacher Services should be used before appointing a teacher to check for:

  • the award of qualified teacher status (QTS)
  • completion of teacher induction
  • prohibitions, sanctions and restrictions that might prevent the individual from taking part in certain activities or working in specific positions

It’s a free service for schools, sixth-form and further education (FE) colleges, local authorities and teacher supply agencies in England. It’s accessed through Department for Education’s (DfE) Sign-in portal.

Right to Work

You must check that a job applicant is allowed to work for you in the UK before you employ them.

You can:

You can also check an applicant’s right to work by using an identity service provider that offers Identity Document Validation Technology (IDVT). You can find out more about IDVT in the employer’s guide to right to work checks: 6 April 2022.

You do not need to do checks for existing employees from the EU, EEA or Switzerland if they came to the UK before 1 July 2021.

Irish citizens can use their Irish passport and passport card to prove their right to work.

Disqualification: Child Care Act 2006

Staff are covered by this legislation if they are employed or engaged to provide early years childcare (this covers the age range from birth until 1 September following a child’s fifth birthday, that is up to and including reception year) or later years childcare (this covers children above reception age but who have not attained the age of 8) in nursery, primary or secondary school settings, or if they are directly concerned with the management of such childcare.

Section 128 Check

The guidance outlines:

  • the section 128 legislation that prohibits or restricts an individual managing an independent educational setting or governing a local-authority maintained school
  • how to assess and consider if someone is unsuitable
  • how to report someone as unsuitable to manage an independent school, academy or free school

The Education Secretary can prohibit or restrict an individual from taking part in the management of independent school under section 128 of the Education and Skills Act 2008.

This applies to current prospective governors only in state schools
