Introduction

Admissions Arrangements

If the local authority manages your admissions process, refer parents to the local authority to find out about your school’s admission and appeal arrangements.
The purpose of the Code is to ensure that all school places for maintained schools are allocated and offered in an open and fair way. All schools must have admission arrangements that clearly set out how children will be admitted, including the criteria that will be applied if there are more applications than places at the school. Admission arrangements are determined by admission authorities.

Charging and remissions policies

You must publish your school’s charging and ‘remissions’ policies (this means when you cancel fees). The policies must include details of: the activities or cases where your school will charge pupils’ parents;  the circumstances where your school will make an exception on a payment you would normally expect to receive under your charging policy

School Opening Hours

Schools should publish on their website their opening and closing times and the total time this amounts to in a typical week (for example 32.5 hours).
Schools should show the compulsory times they are open. This time runs from the official start of the school day (morning registration) to the official end of the compulsory school day. It includes breaks, but not optional before or after school activities.

For local-authority-maintained schools with a delegated budget the governing body is free to decide how often you review schemes for paying governors’ allowances. We advise that governing bodies review this requirement annually.

PE and Sport Premium

If your school receives PE and sport premium funding, you must publish:
the amount of premium received
a full breakdown of how it has been spent (or will be spent)
what impact the school has seen on pupils’ PE and sport participation and attainment
how the improvements will be sustainable in the future
You are also required to publish the percentage of pupils within your year 6 cohort who met the national curriculum requirement to:
swim competently, confidently, and proficiently over a distance of at least 25 metres
use a range of strokes effectively (for example front crawl, backstroke, and breaststroke)
perform safe self-rescue in different water-based situations

Capability of Staff

Appraisal arrangements are set out in the Education (School Teachers’ Appraisal) (England) Regulations 2012 (the Appraisal Regulations). The Appraisal Regulations set out the principles that apply to teachers in all maintained schools and centrally employed (or unattached) teachers employed by a local authority, in each case where they are employed for one term or more.

School suspensions and permanent exclusions

Under the Education and Inspections Act 2006, headteachers of maintained schools and pupil referral units must determine measures to be taken with a view to:
• promoting, among pupils, self-discipline, and proper regard for authority,
• encouraging good behaviour and respect for others on the part of pupils and, in particular, preventing all forms of bullying among pupils,
• securing that the standard of behaviour of pupils is acceptable,
• securing that pupils complete any tasks reasonably assigned to them in connection with their education, and
• otherwise regulating the conduct of pupils.
Permanent exclusions can be used to help achieve these aims when they are absolutely necessary, as a last resort.

Designated teacher for looked-after and previously looked-after children

Section 20 of the 2008 Act places the following duties on governing bodies:
• to designate a member of staff (the designated teacher) as having the responsibility to promote the educational achievement of looked-after children, including those aged between 16 and 18 who are registered pupils at the school;
• to ensure that the designated teacher undertakes appropriate training (section 20(2); and
• the governing body and the designated teacher must have regard to this guidance and any other relevant guidance issued by the Secretary of State.
